- Who is the recipient ?

The report is forwarded to the reporting system coordinators: Marthe Villafagne, Equality and Anti-Discrimination Project Manager at the Equality and Diversity Mission at Lyon 1, and Ana?l Jeannin, Equality and Anti-Discrimination Project Manager. After reviewing the testimony submitted online, the reporting system coordinator will contact you via the communication method you indicated within a maximum of five business days.
You will be offered a one-hour listening interview with a person trained in listening and addressing issues of harassment, violence, and discrimination. The date will be determined based on your availability and that of the listening person. The interview can be conducted in person, by video, or by telephone, depending on your preferences. If you have specific requirements regarding the meeting location, you can indicate them directly in the form so that we can select a suitable location. - Who is it made for ?

The form can be used by any member of staff or any student of the Claude Bernard Lyon 1 University who has been a victim or witness of moral, sexual or discriminatory harassment, sexist and sexual violence, or discrimination of any kind.
- For what situations ?

The form can be used for any situation involving exposure to moral, sexual, or discrimination that causes distress, discomfort, or suffering. These situations can be collective or individual.
* Moral harassment: No employee should be subjected to repeated acts of moral harassment that have the purpose or effect of degrading their working conditions in a way that could infringe on their rights and dignity, harm their physical or mental health, or compromise their professional future. Article L1152-1 du Code du travail
* Bullying: No student shall be subjected to acts of harassment resulting from comments or behaviors committed within the educational establishment or on the fringes of school or university life and having the purpose or effect of undermining their dignity, damaging their physical or mental health or degrading their learning conditions. These acts may constitute the offense of bullying provided for in 222-33-2-3 du code pénal. (loi n°2022-299 du 2 mars 2022).* Sexual harassment : this is the repeated imposition on a person of comments or behaviors with sexual or sexist connotations which either undermine their dignity due to their degrading or humiliating nature, or create an intimidating, hostile or offensive situation for them. Article 222-33 du Code pénal
* Discrimination : Discrimination is any distinction made between natural persons on the basis of their origin, sex, family situation, pregnancy, physical appearance, particular vulnerability resulting from their economic situation, whether apparent or known to the person making it, their surname, place of residence, state of health, loss of autonomy, disability, genetic characteristics, morals, sexual orientation, gender identity, age, political opinions, trade union activities, ability to express themselves in a language other than French, or their membership or non-membership, real or supposed, of a specific ethnic group, nation, so-called race or religion.
Discrimination also includes any distinction made between legal entities on the basis of origin, sex, family situation, pregnancy, physical appearance, particular vulnerability resulting from the economic situation, apparent or known, of its author, surname, place of residence, state of health, loss of autonomy, disability, genetic characteristics, morals, sexual orientation, gender identity, age, political opinions, trade union activities, ability to express oneself in a language other than French, membership or non-membership, real or supposed, of a specific ethnic group, nation, alleged race or religion of the members or certain members of these legal entities.
Article 225-1 du Code pénal - What happens after reporting ?

If the report is not anonymous, a person within the listening team will be designated to welcome you and listen to you. An appointment will be offered with the listener in the days/weeks following the report. During this appointment, support with other internal and/or external partners of the listening unit (psychologist, associations, etc.) will be offered to you. The appointment results in a listening report. Based on this listening report and with your agreement, proposals will be made by an interdisciplinary team to put an end to the situation of harassment, violence or discrimination and to protect and support the victims.

Reporting is confidential. The information you provide is only accessible to the person overseeing your case and who will contact you using the contact information you provide. This information will not be shared with anyone else. Confidentiality may be waived at your request if you wish to initiate disciplinary (internal to the University) or criminal proceedings. All members of the listening and support system are also subject to a confidentiality clause. They may not share any information other than that strictly necessary for your support and with your consent. This form will not be included in your administrative/academic file or your medical file. The information it contains is destroyed at the end of the support process. A report may be submitted anonymously; however, the system cannot assist a person who does not provide their identity.
- The stages of reporting

1. The Mission for Equality and Diversity receives notification of the report.
2. The report is reviewed by Marthe Villafagne and Ana?l Jeannin, who have access to the details and acknowledge receipt.
3. An appointment with a counselor is proposed.
4. The person who filed the report confirms the appointment proposal.
5. The counselor confirms the appointment date.*
*There is one counselor team for students and another team for staff.2. Interview
1. The person who filed the report is interviewed by a member of the listening team. They may be accompanied.
2. The listening team completes a reporting form.
3. The reporting form is reviewed and validated by the person being listened to.
4. The listening team requests the opportunity for the person being listened to to present their case to the small team in one of two ways:? the listener agrees to extend confidentiality to the listening team
X If the person being listened to does not wish to extend the confidentiality, the situation cannot be handled by the restricted team.
3. Problem solving
1. The situation is presented to a small team according to the terms chosen by the listener.
2. The small team discusses and proposes solutions.
3. The solutions are proposed to the listener.
4. If the listener approves the proposed solutions, they are implemented.
The person who files the report retains the decision-making power at each stage. - What will be done with these datas ?

Your data is confidential for as long as you wish. It is only accessible to the people who are handling your case (the contact person who contacted you and who is monitoring you, and the project manager, who manages the listening and support system). Personal data is retained until the situation is resolved. It can be destroyed at any time, at your request. This website and its data entry form are subject to the institution's GPDR regulations

If you are unwilling, unable, or unwilling to contact the university's hotline, Lyon-based associations that partner with the university can assist you.
You can also file a preliminary complaint for a discriminatory act (discrimination, defamation, insult, or individual incitement to hatred).
